CERDOMUS does not accept any responsibility regarding the contents of this site, nor shall it issue any guarantee concerning the absence of software potentially or effectively damaging to the user ("User") of the site, such as viruses, worms, Trojans, etc. Furthermore, CERDOMUS does not guarantee that the use of this site cannot cause damage of any kind to the User, including damage to IT equipment and/or software.

5. TRANSMITTED INFORMATION

Any information transmitted by the User to CERDOMUS through this site, including, but not restricted thereto, messages, suggestions, ideas and creative ideas, projects, suggestions, data of any type, results of commercial and marketing surveys ("Transmitted Information") shall be considered as non confidential.

The transmission of any Transmitted Information shall be considered as an irrevocable free-of-charge transfer by the User to CERDOMUS of all and any right held by the User regarding the said Information. Consequently, CERDOMUS may freely use, in any form and by any method, the contents of the Information or part of the same, and shall therefore not be obliged to: (I) keep the Transmitted Information confidential, (II) pay sums for the use, in any form or by any method, of the Transmitted Information.

The User guarantees that the transfer in favor to CERDOMUS of the Transmitted Information and the use of the same by CERDOMUS does not in any way violate, in whole or in part, the rights of third parties including, but not restricted thereto, of intellectual and industrial property rights, of personality rights, and of property rights, and is not tantamount to a breach of industrial or commercial secrets.

Therefore, the sole party responsible for the contents of the Transmitted Information shall be the User who transmitted them. In particular, the User shall protect CERDOMUS against any claim which third parties may vindicate in connection with rights of any kind and, especially, regarding the Transmitted Information.

6. PROTECTION OF PERSONAL DATA

CERDOMUS guarantees that all data supplied by the User shall be treated according to the legal provisions on the privacy of information , in observance of Italian Law No. 675/96.

According to article 1, sub-paragraph 2, letter B of Italian Law 675/1996, treatment means: "any operation or set of operations, carried out with or without use of electronic means or however automated, concerning the gathering, registration/recording, organization, preservation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, cancellation and destruction of the data".

The gathered data, treated lawfully and correctly, shall be used by CERDOMUS solely and exclusively for: a) supplying the services offered by this site, b) verifying the User's level of satisfaction, c) informing the User about any new products, new initiatives, events and services, d) communicating commercial offers regarding the products or services supplied by CERDOMUS, or by associated or subsidiary companies or with which CERDOMUS has stipulated or shall stipulate commercial agreements, e) fulfilling legal obligations.

CERDOMUS may treat the data with manual and IT instruments aimed at memory-storing, managing and transmitting the said data.

Use of this site implies the authorization by the User of the treatment of his/her personal data for the purposes described above.

The User has the right at any time to know the existence of personal data concerning him/her, and to know the origin of the data that concern him/her as well as the logic and aims on which the treatment is based, and also to know about the transformation into anonymous form, cancellation, updating and/or correction/integration of the personal data which concern him/her, and to contest the treatment of the data for legitimate reasons, although said data may pertain to the purpose of the gathering, and to contest the treatment of the data aimed at sending advertising material or for the purpose of commercial information.

7. APPLICABLE LAW AND COMPETENT COURT OF LAW

These Conditions are exclusively regulated by Italian Law ("Applicable Law"). Any dispute concerning these Conditions and the use of the Site shall be regulated by the Applicable Law and shall be the exclusive competence of the Bologna Court of Law ("Competent Court of Law"). The use of this site entails the acceptance of the Applicable Law and the Competent Court of Law.

8. VALIDITY OF THIS DISCLAIMER

The partial nullity of the Conditions, or the nullity of individual clauses of parts of them, shall not lead to the nullity of the entire Conditions; the null clauses or parts shall be replaced by right by mandatory legal provisions.
